Elderly Kwa-Thema woman fights decade-long battle for late brother’s RDP home



Kwa-Thema – Mariam Mabena (86) has lost all hope after years of fighting for her deceased brother’s property in Ext 3.
“My brother died in August 2012, so some members of the public located me. We buried him here at the family home in Vergnoeg,” she explained.
Petrus ‘Rooi’ Mabena was a Reconstruction and Development Programme beneficiary. He lived with his partner at the time and had no biological children.
“The trouble started after the funeral. When we asked his partner for the keys to the property, she denied us access. Unfortunately, not long after that, she also passed away,” she added.
The occupant still refuses her access.
Mabena sought legal advice. She approached the high court for a letter of authority and acquired an eviction letter for whoever remained at the address.
The occupants ignored the letter.
“I have had no peace all these years. I think it is also making me physically sick. I have done everything the right way, but it has not worked out well for my family. My greatest fear is that I will die and this issue will never be resolved,” she said.
